Senator Rand Paul has been a vocal critic of efforts to ban TikTok in the United States, consistently emphasizing the importance of First Amendment rights. He has argued that prohibiting the app would infringe upon free speech and lacks substantial evidence to justify such a measure.

In March 2023, Paul blocked Senator Josh Hawley’s “No TikTok on United States Devices Act,” stating that a ban would violate the First Amendment and highlighting that U.S.-based tech companies have also faced data security challenges.

On January 17, 2025, following the Supreme Court’s decision to uphold the TikTok ban, Senator Paul expressed his disappointment, reiterating his stance that banning a social media app like TikTok constitutes a First Amendment violation. He emphasized the lack of concrete evidence supporting the ban, stating, “Most of the reasons the government banned it were based on accusations, not proof.”

In December 2024, Senator Paul, alongside Senator Ed Markey, urged President Joe Biden to extend the January 19 deadline for ByteDance to divest its U.S. assets by 90 days. They highlighted the law’s uncertain future and its potential consequences for free expression, advocating for a more measured approach.

Throughout the legislative process, Paul has maintained that the TikTok ban poses a serious threat to constitutional rights, urging Congress to reconsider the law. He continues to advocate for solutions that address national security concerns without compromising fundamental freedoms.
